Welcome to LiberationInMind’s website, mobile applications, and related digital platforms (the “Service”). By accessing or using our Service, you agree to comply with and be bound by the following terms and conditions (the “Terms”). Please read these Terms carefully before using our Service.

1. Definitions
For the purposes of these Terms:
“Account” refers to a unique account created for you to access our Service or parts of our Service.
“Content” refers to any text, graphics, images, audio, video or other material that can be viewed on the Service, including any user-generated content.
“Device” means any device that can access the Service, such as a computer, smartphone, or tablet.
“Free Trial” refers to a limited period during which you can access the Service at no cost, as specified by LiberationInMind. The conditions and duration of any Free Trial will be clearly outlined at the time of offering.
“In-App Purchases” refers to the purchase of digital goods, services, or recurring subscriptions made directly through our mobile applications on platforms such as the Apple App Store or Google Play Store.
“Website Purchase” refers to the purchase of products, subscriptions, or services through our website, which are available for users to buy using provided payment methods.
“Feedback” refers to any suggestions, comments, or ideas you provide regarding the Service, including ways to improve the Service or any other input provided by you.
“Subscription” refers to a paid plan that provides access to specific features or content within the Service for a recurring period, as specified at the time of the purchase.
“Subscription Period” refers to the time period for which a Subscription is valid, as defined during the purchase process (e.g., monthly, annually).
“Subscription Cancellation” refers to the process by which you or LiberationInMind may terminate or cancel a Subscription, subject to the terms outlined in this policy.
“Service” refers to the website, mobile applications (including iOS and Android apps), and any related products or services offered by LiberationInMind.
“Your Content” means all works and materials (including without limitation text, graphics, images, audio material, video material, scripts, software and files) that you submit to our Service for storage or publication on, processing by, or transmission via, our Service.
“Terms” refers to these Terms and Conditions, as amended from time to time.
“User,” “You,” or “Your” refers to the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.
“LiberationInMind” or “We,” “Us,” or “Our” refers to LiberationInMind, including Dr Paul Ogilvie, or any representative of, or contributor to LiberationInMind

2. Acceptance of Terms

2.1 By accessing and using the Service, you accept and agree to be bound by these Terms and our Privacy Policy. If you download, install, or use our mobile applications, you also agree to comply with the App Store and Google Play Store terms of service.

2.2 If you do not agree to these Terms, please do not use our Service.

3. Use of the Service

3.1 You must be 18 years of age, or the age of majority in your province, territory, or country, to use our website, products and services. Individuals under the age of 18, or the applicable age of majority, may utilise our website, products and services, only with the involvement and consent of a parent or legal guardian, under such person’s supervision and account and otherwise subject to these Terms.

3.2 You agree to use the Service only for lawful purposes. You are prohibited from using the Service to:
(a) Engage in any illegal activity or infringe the rights of others.
(b) Post or transmit any harmful, abusive, defamatory, or offensive content.
(c) Interfere with or disrupt the operation of the Service or its servers.
(d) Attempt to gain unauthorized access to any portion of the Service.

4. Intellectual Property

4.1 All content on the Service, including but not limited to text, graphics, logos, icons, images, audio, video and software, is the property of LiberationInMind or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. All rights are reserved.

4.2 Users are granted a limited, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes only.

5. Licence to use our Service

5.1 You may only use our Service for your own personal purposes, and you must not use our Service for any other purposes.

5.2 Except as expressly permitted by these terms and conditions, you must not edit or otherwise modify any material on our Service.

5.3 Unless you own or control the relevant rights in the material, you must not:
(a)   republish material from our Service;
(b)   sell, rent or sub-license material from our Service;
(c)   exploit material from our Service for a commercial purpose; or
(d)   redistribute material from our Service.

5.4 We reserve the right to restrict access to areas of our Service, at our discretion; you must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on our Service.

6. User Accounts

6.1 To access certain features of the Service, you may need to create an Account. You agree to provide accurate, current, and complete information and keep it updated.

6.2 You are responsible for maintaining the confidentiality of your Account and password and for restricting access to your Account.

6.3 If you access the Service via Apple or Google account sign-in, your use of those sign-in methods is subject to their respective terms.

7. Free Trial

7.1 LiberationInMind may offer a Free Trial to new users. After the Free Trial ends, regular subscription fees apply unless cancelled before expiry.

7.2 LiberationInMind reserves the right to modify or terminate Free Trials at any time, without notice.

8. In-App Purchases

8.1 Certain features may be available through In-App Purchases. All transactions made through the Apple App Store or Google Play Store are processed by those platforms and are subject to their payment terms and refund policies.

8.2 For Apple users: refunds and billing issues must be handled through Apple Support.
For Google Play users: refunds and billing issues must be handled through Google Play Support.

8.3 All prices and availability are subject to change. In-App Purchases are final and non-refundable to the fullest extent permitted by law.

9. Website Purchases

9.1 By making a Website Purchase, you agree to pay all applicable fees and taxes as displayed during checkout.

9.2 LiberationInMind does not collect or store your credit card details. Payments are securely processed through PayPal.com, Gumroad.com, or Stripe.com, subject to their respective terms:

9.3 Website Purchases and Subscriptions are non-refundable once access to the digital product has been provided, except where required by UK consumer law.

10. Subscriptions

10.1 Certain features of the Service require an active Subscription. Subscriptions automatically renew unless cancelled.

10.2 If you purchased a Subscription via the App Store or Google Play, cancellation must be made through your Apple ID or Google Play account settings, respectively.

10.3 You will be billed in advance for each Subscription Period, and renewal fees will be charged using your original payment method unless you cancel before the renewal date.

10.4 LiberationInMind reserves the right to suspend or cancel any Subscription for misuse or violation of these Terms.

11. Feedback

11.1 We welcome your feedback. However, you understand that any Feedback you provide to us is voluntary and non-confidential, and you grant LiberationInMind a perpetual, royalty-free licence to use such Feedback without any obligation to compensate you.

13. Third-Party Links and Services

13.1 Our Service may contain links to third-party websites, services or apps. These links are provided for your convenience and do not imply endorsement by LiberationInMind. We are not responsible for their content, practices, or any resulting loss or damage.

13.2 Your use of any third-party services, such as payment processors or app-store platforms, is subject to their own terms and privacy policies.

14. Third party rights

14.1 A contract under these terms and conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party.

14.2 The exercise of the parties’ rights under a contract under these terms and conditions is not subject to the consent of any third party.

14.3 No third party has the right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

15. User-Generated Content: Your Content

15.1 You may be able to submit, post, or upload content to the Service (e.g., comments, feedback, etc.). By submitting content, you grant LiberationInMind a non-exclusive, worldwide, royalty-free, and transferable licence to use, display, reproduce, modify, and distribute your content on the Service.

15.2 You represent and warrant that:
(a) You own the rights to the content you submit.
(b) Your content does not violate the rights of others or any applicable laws.

16. Your Content: Licence

16.1 In these terms and conditions, “Your Content” means all works and materials (including without limitation text, graphics, images, audio material, video material, scripts, software and files) that you submit to our Service for storage or publication on, processing by, or transmission via, our Service.

16.2 You grant us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate, distribute, and display Your Content in connection with the operation, promotion, or improvement of the Service.

16.3 You grant to us the right to sub-license the rights licensed under Section 16.2.

16.4 You grant to us the right to bring an action for infringement of the rights licensed under Section 16.2.

16.5 You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.

16.6 Without prejudice to our other rights under these terms and conditions, if you breach any provision of these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may delete, unpublish or edit any or all of your content.

17. Your Content: Rules

17.1 You warrant and represent that your content will comply with these terms and conditions.

17.2 Your content must not be illegal or unlawful, must not infringe any person’s legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).

17.3 Your Content, and the use of your content by us in accordance with these terms and conditions, must not:
(a)   be libellous or maliciously false;
(b)   be obscene or indecent;
(c)    infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right;
(d)   infringe any right of confidence, right of privacy or right under data protection legislation;
(e)   constitute negligent advice or contain any negligent statement;
(f)    constitute an incitement to commit a crime, instructions for the commission of a crime or the promotion of criminal activity;
(g)   be in contempt of any court, or in breach of any court order;
(h)   be in breach of racial or religious hatred or discrimination legislation;
(i)    be blasphemous;
(j)    be in breach of official secrets legislation;
(k)   be in breach of any contractual obligation owed to any person;
(l)    depict violence in an explicit, graphic or gratuitous manner;
(m)  be pornographic, lewd, suggestive or sexually explicit;
(n)   be untrue, false, inaccurate or misleading;
(o)   consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury, or death, or any other form of loss or damage;
(p)   constitute spam;
(q)   be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory; or
(r)    cause annoyance, inconvenience or needless anxiety to any person.

18. Termination

18.1 We may suspend or terminate access to your Account at any time for breach of these Terms, security concerns, or misuse. If termination occurs, access to paid features will cease at the end of your current billing cycle, unless we are required by law or for security reasons to terminate access sooner.

19. Limitation of Liability

19.1 To the fullest extent permitted by law, LiberationInMind, Dr Paul Ogilvie, and any other employed or non-employed contributor to LiberationInMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:
(a) Your use or inability to use the Service.
(b) Unauthorized access or alterations to your content.
(c) Any third-party conduct or content on the Service.

20. Disclaimer of Warranties

20.1 General Disclaimer

The Service is provided on an “AS IS,” “WITH ALL FAULTS,” and “AS AVAILABLE” basis, without any representations or warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, LiberationInMind disclaims all warranties, express, implied, or statutory, including but not limited to:
(a) Implied warranties of merchantability (i.e., the Service meets a basic level of quality and is fit for its ordinary purposes);
(b) Fitness for a particular purpose (i.e., the Service meets your specific needs or intended use, regardless of whether LiberationInMind was advised of such purpose);
(c) Non-infringement (i.e., the Service does not violate the intellectual property rights of others);
(d) Security, accuracy, and reliability (i.e., the Service will be secure, accurate, or reliable in all circumstances).

20.2 No Warranty or Representation

LiberationInMind makes no warranty or representation that:
(a) The Service will meet your requirements or expectations.
(b) The Service will always be available, uninterrupted, timely, secure, or error-free.
(c) Any defects or errors in the Service will be corrected promptly or at all.
(d) The Service or its content will be free from viruses, malware, or other harmful components.
(e) That the information obtained from this Service is complete or accurate; or
(f) That the material obtained from this Service is up to date.

20.3 Performance and Accuracy

LiberationInMind does not guarantee the accuracy, completeness, or usefulness of any content available through the Service. You understand and agree that any reliance on such content is at your own risk. Any information provided on the Service, whether expressed by LiberationInMind or third parties, is not intended to be professional or medical advice, and LiberationInMind disclaims any liability for actions taken based on such information.

20.4 Third-Party Content and Links

The Service may contain links to or content from third-party websites or services. LiberationInMind does not endorse, warrant, or assume responsibility for the accuracy, legality, or reliability of any information, products, or services provided by third parties. 20.5 Data and Information Security

While LiberationInMind takes reasonable efforts to protect your data and ensure the security of your personal information, we make no warranties or representations regarding the confidentiality, security, or integrity of any data or information transmitted to or from the Service. Any transmission of data through the internet is done at your own risk.

20.6 No Warranty for Results

LiberationInMind makes no warranty that your use of the Service will yield specific results. Any descriptions, claims, or representations of the performance of the Service are not guarantees of actual results. You acknowledge that outcomes or performance may vary based on factors beyond LiberationInMind’s control, including your use, the nature of the Service, or third-party elements.

20.7 No Responsibility for Downtime, Interruptions, or Discontinuation

20.8 LiberationInMind shall not be liable for any delay, interruption, or unavailability of the Service resulting from routine maintenance, system upgrades, or unforeseeable events such as internet outages, cyber-attacks, acts of God, or any other event that is beyond the reasonable control of LiberationInMind.

20.9 We reserve the right to discontinue or alter any or all of our Services and to stop our Service, in part or in full, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any of our Services.

20.10 No Creation of Warranty by Communication

No oral or written advice or information provided by LiberationInMind, its employees, its authorized representatives or contributors shall create any warranty or representation unless expressly stated in these Terms.

20.11 Jurisdictional Limitations

These Terms and Conditions are governed by and construed in accordance with the laws of England, without regard to its conflict of law principles. By accessing or using this Service, you agree that any disputes arising out of or relating to these terms will be subject to the exclusive jurisdiction of the courts located in England.

20.12 LiberationInMind, Apple Inc., Google LLC, and their subsidiaries are independent entities. Apple and Google are not responsible for the Service, its maintenance, or any claims related to it.

21. Medical Disclaimer

21.1 The information provided by this Service, including text, graphics, images, audio, video and other material, is for informational purposes only and is not intended to serve as a substitute for professional medical advice, diagnosis, or treatment.

21.2 This Service is provided without any representations or warranties, express or implied.

21.3 No Professional Relationship
(a) The use of this Service does not establish a doctor-patient, therapist-client, or any other professional relationship between you and LiberationInMind or any contributors to the Service.
(b) Our Service may include features that allow you to communicate with us. You acknowledge that, because of the limited nature of communication through our Service, that any assistance you may receive using any such features is likely to be incomplete, and may even be misleading.

22. Acceptable use

24. Trade marks

24.1 LiberationInMind, Dr Paul Ogilvie, our logos and our other registered and unregistered trade marks are trade marks belonging to us; we give no permission for the use of these trade marks, and such use may constitute an infringement of our rights.

24.2 The third party registered and unregistered trade marks or service marks on our website are the property of their respective owners and, unless stated otherwise in these terms and conditions, we do not endorse and are not affiliated with any of the holders of any such rights and as such we cannot grant any licence to exercise such rights.

25. Assignment

25.1 You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.

25.2 You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.

26. Dispute Resolution

26.1 Negotiation
(a) In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service (a “Dispute”), you agree to first attempt to resolve the Dispute informally by contacting us at support@liberationinmind.com. We will attempt to resolve the Dispute through negotiation within 30 days from the date you notify us of the Dispute.

26.2 Class Action Waiver
(a) You agree that any Dispute resolution proceedings will be conducted on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action. You waive any right to bring or participate in a class action lawsuit.

26.3 Governing Law
(a) The laws of England shall govern this Dispute Resolution process.

26.4 App-Store Mediation
(a) If a dispute arises related to an In-App Purchase made through Apple or Google, you must follow the dispute resolution procedures of that respective platform before contacting LiberationInMind.

27. Severability

27.1 If a provision of these terms and conditions is determined by any court, or other competent authority, to be unlawful and/or unenforceable, the other provisions will continue in effect.

27.2 If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

28. Changes to the Terms

28.1 We reserve the right to modify these Terms at any time. Changes will be effective upon posting. It is your responsibility to review these Terms periodically for any updates. Your continued use of the Service after the changes have been made will constitute your acceptance of the revised Terms.

29. Entire agreement

29.1 These terms and conditions, together with our privacy and cookies policy, shall constitute the entire agreement between you and us in relation to your use of our Service and shall supersede all previous agreements between you and us in relation to your use of our Service.

30. Law and jurisdiction

30.1 These terms and conditions shall be governed by and construed in accordance with English law.

30.2 Any disputes arising from these Terms or your use of the Service shall be subject to the jurisdiction of the courts of England.
